Terms of use

  1. Purpose and acceptance. These terms govern the use of the VSRouter application for computers, its browser extension, and the website vsrouter.com (together, the "Service"), published by an individual (the "Publisher"; see the legal notice). By downloading, installing, accessing or using any part of the Service, you ("the User") accept these terms in full. If you do not accept them, do not use the Service.
  2. Nature of the Service. The Service is a tool for players of online sailing games. It displays public weather forecasts and computes suggested routes and orders. It is provided free of charge, for personal and non-commercial use only. It is not a navigation aid and must never be used to navigate a real vessel or for any purpose where an error could cause harm, loss or damage.
  3. Licence. Subject to these terms, the Publisher grants the User a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Service on devices the User owns or controls. The Service is licensed, not sold. All rights not expressly granted are reserved.
  4. Restrictions. The User shall not, and shall not allow anyone to:
    • copy, modify, adapt, translate or create derivative works of the Service, in whole or in part;
    • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data or structure of the Service, except to the extent that applicable law expressly permits it notwithstanding this restriction;
    • circumvent, disable or interfere with any security, update, signature or integrity mechanism of the Service;
    • gain or attempt to gain unauthorised access to the Service, its servers, its storage or its data, or disrupt, overload or impair them, including by automated or excessive requests;
    • distribute, publish, sell, rent, lend, lease, sublicense, host or otherwise make the Service or any part of it available to third parties, including through mirrors, repackaged installers or modified extensions;
    • remove or alter any notice of copyright, trademark, licence or attribution;
    • use the Service for any unlawful purpose, or in breach of the terms of any third-party game or service.
  5. Third-party games and data. The Service is independent and is not affiliated with, endorsed by or connected to Virtual Regatta or any other game publisher. The User alone is responsible for complying with the rules and terms of any game played with the Service; the Publisher gives no assurance that any use of the Service is permitted by them. Weather data, maps and other content from third parties are provided as received from their sources, under their own terms, and may be inaccurate, incomplete, delayed or unavailable.
  6. No warranty. The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose and non-infringement. The Publisher does not warrant that the Service will be uninterrupted, error-free, secure or free of harmful components, that routes, forecasts or orders will be correct, or that any defect will be corrected.
  7. Limitation of liability. To the fullest extent permitted by applicable law, the Publisher shall not be liable for any damage or loss of any kind, whether direct, indirect, incidental, special or consequential, including loss of data, of ranking, of in-game progress or items, of time, of opportunity or of revenue, arising out of or in connection with the Service, its use or the inability to use it, even if advised of the possibility of such damage. The User uses the Service at their sole risk and is solely responsible for their use of it, for the decisions and orders they make, and for their devices and data. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
  8. Indemnity. The User shall indemnify and hold harmless the Publisher against any claim, loss, liability or expense, including reasonable legal fees, arising from the User's breach of these terms or misuse of the Service.
  9. Intellectual property. The Service, including its software, design, texts, graphics, names and logos, is the property of the Publisher or its licensors and is protected by intellectual property laws. Open-source components are governed by their own licences, listed in the application under Help › Acknowledgements.
  10. Updates, changes and termination. The Publisher may update, modify, suspend or discontinue all or part of the Service at any time, without notice and without liability. The licence ends automatically if the User breaches these terms; the User must then stop using the Service and delete all copies of it. Sections 4 to 8, 12 and 13 survive termination.
  11. Personal data. How the Service handles data is described in the privacy policy.
  12. Changes to these terms. The Publisher may amend these terms at any time. The amended terms apply from their publication on this page, the date at the top being updated. Continued use of the Service after publication constitutes acceptance of the amended terms.
  13. Governing law and jurisdiction. These terms are governed by French law. Any dispute relating to them shall be submitted to the competent French courts, without prejudice to any mandatory rule protecting a consumer in their country of residence. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. The failure to enforce a provision is not a waiver of it. The French version of these terms prevails in case of conflict.
